1. Service Description

SafeDrop India provides a technology platform that connects schools and parents with a network of verified, independent drivers to provide supplemental student transportation. Our Services include route optimization, live vehicle tracking, real-time notifications, and safety monitoring features. We are a technology service provider and are not a transportation carrier.

2. User Accounts

To use our Services, you must register for an account. You agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate, current, and complete. You are responsible for safeguarding your password and for any activities or actions under your account.

3. Obligations of Users

a) Schools and Administrators:

• You represent and warrant that you have obtained all necessary consents from parents or legal guardians to provide us with student data required for the provision of our Services.
• You are responsible for providing accurate and up-to-date information regarding student schedules, pickup/drop-off locations, and contact details.
• You agree to use the platform's communication tools and data for official purposes related to student transportation and safety only.

b) Parents and Guardians:

• You are responsible for ensuring your child is ready for pickup at the designated time and location.
• You agree to provide accurate information regarding your address and any specific needs of your child.
• You agree to use the live tracking and communication features responsibly and for the sole purpose of monitoring your child's safety during their trip.

c) Drivers (Pilots):

• You represent and warrant that you are an independent contractor and not an employee of SafeDrop India.
• You must maintain a valid driver's license, vehicle registration, comprehensive insurance, and all other required permits as per the laws of India.
• You agree to adhere to all traffic laws, safety guidelines, and the SafeDrop India code of conduct at all times.
• You must maintain your vehicle in a safe, clean, and roadworthy condition.
• You consent to continuous background checks and the collection of real-time location data during active trips.

4. Safety and Conduct

All users agree to interact respectfully and professionally. Any form of harassment, abuse, or unsafe behavior is strictly prohibited and will result in immediate termination of access to the Services. Users are required to report any safety concerns or incidents to SafeDrop India immediately.

5. Payments and Fees

Payment terms for our Services will be governed by a separate service agreement entered into between SafeDrop India and the respective school or user. All payments are due as specified in the agreement, and failure to make timely payments may result in suspension or termination of service.

6. Intellectual Property

The Service and its original content (excluding data provided by users), features, and functionality are and will remain the exclusive property of SafeDrop India and its licensors. Our trademarks, including "SafeDrop India" and "RouteSafe AI™," may not be used in connection with any product or service without our prior written consent.

7. Limitation of Liability

To the maximum extent permitted by applicable law, in no event shall SafeDrop India, nor its directors, employees, partners, agents, or affiliates, be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from (i) your access to or use of or inability to access or use the Service; (ii) any conduct or content of any third party on the Service; (iii) any content obtained from the Service; and (iv) unauthorized access, use, or alteration of your transmissions or content, whether based on warranty, contract, tort (including negligence), or any other legal theory.

SafeDrop India is a technology platform that connects users and is not responsible for the actions, negligence, or conduct of any user (including drivers). Our total liability in any matter arising out of or related to these terms is limited to the amount paid by you for the Services in the 12 months preceding the event giving rise to the liability.

8. Indemnification

You agree to defend, indemnify, and hold harmless SafeDrop India and its licensee and licensors, and their employees, contractors, agents, officers, and directors, from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not to attorney's fees), resulting from or arising out of a) your use and access of the Service, or b) a breach of these Terms.

9. Governing Law

These Terms shall be governed and construed in accordance with the laws of India, without regard to its conflict of law provisions. All disputes arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts in Kanpur, Uttar Pradesh.

10. Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.
